Article 27 Public Holidays
1. Recognized public holidays, provided if they do not fall on a Saturday or Sunday, include:
■ New year’s day
■ Easter Monday
■ Ascension day
■ Whit Monday
■ Both Christmas days
■ King’s day or a substitute day
■ Liberation day (only in lustrum years, i.e., every five years)
2. If it is not clear from the employment agreement or assignment whether the public holiday falls on a regular working day for the temporary worker, the holiday is granted if:
a. The temporary worker has worked on that specific day at least seven times in the thirteen consecutive weeks leading up to the holiday; or
b. The temporary worker has worked less than thirteen consecutive weeks but has worked on that specific day more than half of the weeks worked.
For the calculation of the thirteen-week period (in a) or less (in b), consecutive agreements are added together if they follow each other within a period of one month. Periods of interruption are not counted.
